Inheritance Tax Act 1984 section 151B

Relevant dependant with pension fund inherited from member over 75

Section 151B dealt with the inheritance tax treatment of pension funds passed to a dependant from a pension scheme member who died aged 75 or over, but this section has been removed from the legislation.

  • Section 151B was introduced by Finance Act 2006 to address the IHT treatment of pension funds inherited by dependants from members who died at age 75 or over.
  • The section was removed from the Inheritance Tax Act 1984 by Finance Act 2011, section 65 and Schedule 16, paragraph 48(b).
  • The omission takes effect in relation to deaths occurring on or after 6 April 2011.
  • For deaths before 6 April 2011, the original provisions of section 151B may still be relevant when dealing with historic cases.
